If you thought that the iPhone lawsuits fad is over, you’re really wrong. Yet another class action lawsuit was filed against Apple because the device’s battery cannot be replaced by the end user.
Filing the class action lawsuit against Apple and AT&T are Zoltan Stiener and Ynez Stiener, represented by the same Oakland, California-based lawyer H. Tim Hoffman that represents Sydney Leung, who filed the previous Apple iPhone battery class action lawsuit.
The charges are breach of contract, fraud, and violation of several California laws. The main idea is that both companies did not inform iPhone buyers that they will have to pay to have their batteries replaced by Apple, which requires the devices to be shipped to them for battery replacement, although initially the batteries are supposed to stay at 80% capability after 400 charges.
As in the previous lawsuit, this class action lawsuit against Apple barely has a chance in court, as Apple alerts all customers about this fact on its website.
Lionel Hutz, The Simpsons lawyer, was not available for comments once again.
