Yeah, I know this won’t be the first, it won’t even be the first pertaining to the iPhone, but they are trying to get a class action suit together over the new firmware and the lack of warranty service. There appears to be two separate groups, the first is all those that did something that might have voided their warranty legitimately, whether it be accessing the iPhone’s flash directly for such things as ringtone hacks (this is class 1).

The second would be those that hacked their iPhones to use 3rd party apps, I would assume this number is huge (this is class 2). Third is for those that actually unlocked their iPhones, and had their warranties voided regardless of whether they restored the iPhone back to its original state before taking it in or not (this is class 3).

Little comfort to those who face bricking their unlocked iPhones or languishing on old firmware forever, but the iPhone DevTeam have been pretty unequivocal at accusing Apple of taking the, let’s say, AT&T pleasing option when it comes to constructing their upgrade. As they told Gizmodo:
“Apple has multiple ways of upgrading the [firmware of the] baseband [radio chip] without committing a 500,000-phone massacre. First, they can issue a secpack [security pack] for everything in the firmware. They could simply issue one of these to restore the value if a regular token is not detected, thus rewriting this part to its original state. This process would most likely defeat any unlock available, Dev Team or iPhone Sim Free, without bricking the iPhone in any way. New firmware updates could also employ new firmware which closes the loophole that allows the use of a secpack for other operations. They could make this method of updating even resistant to tampering or abuse for a unlock. The possibilities are there”

Well, you can wait for the iPhone Dev Team to come up with a solution, and you know they will, they are the gods of the iPhone, I really don’t see why Apple doesn’t just put them on payroll and save us all the hassle. Or, you can lie.

Here is the deal, Apple’s latest firmware somehow changes the IMEI of your phone (I swear that the last time I checked that was illegal) anyways, that’s how the Apple dudes know if you hacked your phone. Apparently though, this is also affecting all of the prepaid wireless iPhones, not just the hacked ones. This bug is unconfirmed as of yet, which is why there is the Rumor tag.
